Zoning Regulations and Permits

                              
If you are planning to build a house, there are many regulations with which you will have to comply, and it can be confusing.  Below you will find some general guidelines, but for specific information, you will need to contact the offices of the jurisdiction within which your lot is located.  It is either a township, village, or city.  Some jurisdictions designate Montgomery County for certain permits.

Before doing any construction planning, you must first obtain a zoning permit, which authorizes that your construction plans are compatible with the surrounding permitted land uses. Within a village or city, begin with contacting the municipal offices to arrange for connection to public water supply and sanitary sewer service.  

Within a township, water supply and septic systems involve different procedures.  For new construction, an adequate well should already have been drilled and monitored for flow before the original owner subdivided his or her lot for sale.  The Combined Health District of Montgomery County issues drilling permits, and the County Planning Commission reviews the drilling report to verify adequate flow.  Drilling reports for existing wells can be accessed at the Ohio Department of Natural Resources Division of Water.  

For new septic systems, a site review needs to be performed by an engineering consultant or a technician from Montgomery Soil and Water Conservation District.  A septic installation permit must then be obtained from the Combined Health District, before a building permit will be issued from your designated jurisdiction.

For existing septic systems, the Combined Health District has archived original septic system records.  If a septic system needs to be replaced, the Health District or Contractor must do a site inspection, and then a permit will be issued from the Health District. 

For the actual construction, permits are needed for the following parts of your construction: building, electrical, plumbing,  driveway (curb cuts).  Also, you must determine if your construction site is within a floodplain, for which special building permits are required.  Building in a floodplain is not recommended.  For a new home, you must also obtain an assigned street address.   If your lot requires subsurface drainage tile, it must be evaluated by our office as having an adequate outlet, before it can be approved by the County Health District.  For additional information on residential drainage, visit the Natural Features page.

Montgomery County has 15 cities, 5 villages, and 9 townships.  Each jurisdiction often has unique requirements for the various permits mentioned above.  Listed below are the telephone numbers for zoning information for each jurisdiction.  Additional information about the other required permits can be obtained through the contacts with zoning departments.  Some permitting is delegated to the County.
